RULES AND REGULATIONS FOR THE PROVISION OF SERVICES IN THE SGH Career Service

Rector’s Regulation No. 18 of the SGH Warsaw School of Economics of 25 February 2022 introduces new RULES AND REGULATIONS FOR THE PROVISION OF SERVICES IN THE SGH Career Service.

General provisions
§ 1 
   
1.    The Rules and Regulations for the provision of services in the SGH Career Service, hereinafter referred to as the “Rules and Regulations”, set out the terms of use for services available in the online portal of the SGH Career Service (hereinafter referred to as the “Portal”) found at  https://kariera.sgh.waw.pl/en, and intended for use by students
and graduates of SGH as well as employers; the Portal features traineeship, internship and job postings as well as other information related to career and professional development.
2.    The Portal's Administrator is the SGH Warsaw School of Economics in Warsaw with its registered office at al. Niepodległości 162, 02-554 Warszawa, hereinafter referred to as the “Administrator.”
3.    The Portal is available for use by:
1)    students and graduates of first-, second-, and third-cycle degree programmes, PhD School programmes, and postgraduate programmes at SGH, as well as PhD students writing their dissertation under extramural programmes who have an account in the @sgh domain, hereinafter referred to as the “Recipients;”
2)    entities offering jobs, traineeships and internships, hereinafter referred to as the “Employers.”

Account creation
§ 2    

1.    Users may access services offered within the Portal after creating an account.
2.    In order to create an account, Users must:
1)    register using the form available on the Portal – for Employers;
2)    log into the Portal using the account in the @sgh domain – for Recipients;
3)    accept the Rules and Regulations.
3.    After an Employer creates an account, they may add representatives (representative accounts). Adding employer representatives is not required for the use of the Portal.
4.    An Employer may have only one main account, and any number of representative accounts in the Portal.
5.    In justified cases, the Administrator may add an account at the request of an Employer representative. Representatives are responsible for the accuracy, correctness and validity of the data provided, and are authorised to act on the behalf of the Employer.
6.    Recipients may have only one account.

Terms of use for Portal services
§ 3    

1.    Portal users must comply with the Rules and Regulations.
2.    The Portal may be used only for intended purposes.
3.    In particular, Users may not:
1)    violate applicable law or principles of community life;
2)    provide false identification details;
3)    spread misleading information, particularly by misusing someone else’s identity;
4)    send messages for own marketing or commercial purposes;
5)    violate etiquette;
6)    disseminate content that negatively impacts the Portal’s image;
7)    disseminate content that negatively impacts the image of SGH or other Users;
8)    use words commonly considered as insults. 
4.    If a User violates the Rules and Regulations, the Administrator may:
1)    give a warning;
2)    order the User to immediately remove irregularities;
3)    block the User’s account until the irregularities are removed;
4)    restrict the User’s access to selected services;
5)    erase data or information entered in violation of the Rules and Regulations;
6)    block or remove the Account.
3.    If there are reasonable doubts as to the accuracy of the data entered by the User, the Administrator may demand that the User produces relevant documents.
4.    The Administrator is not liable for the consequences of providing false or incorrect data.
5.    Copying Portal elements – website, information, texts, photographs, as well as other visual elements, in part or in full, as well as graphic devices placed on the website for public or commercial purposes – is forbidden without the prior consent of the Administrator.
6.    The User may not make their account, including their password, available to third parties, nor use the accounts of other Users. The User is solely liable for damage suffered due to disclosure of their password to third parties.
7.    The User may request that their account be removed by sending an e-mail message to the Administrator at: serwis.kariera@sgh.waw.pl. The account removal procedure begins within 72 hours of the request being accepted.

Use of logotypes and other graphic files
§ 4    

1.    By placing a logotype or other graphic file in the Portal, the User represents that they are authorised to publish it in the Portal and that they do not infringe on third-party rights, including personality rights.
2.    By placing legally protected materials, the User expresses consent for the Administrator to use them for purposes required to ensure proper Portal functioning.
3.    The Administrator may remove logotypes and other graphic files uploaded by the User in cases where they infringe on third-party rights, violate the law, or compromise the reputation of the Administrator, whereas the Administrator must inform the User of the removal and provide reasons.

Portal services
§ 5    

1.    Upon creating their account, the Employer acquires the right to enjoy the following services free of charge:
1)    publishing job, traineeship and internship postings on the Portal;
2)    managing published job, traineeship and internship postings;
3)    modifying own User account.
2.    Upon creating their account, the Recipient acquires the right to enjoy the services offered on the Portal free of charge; these services include:
1)    searching for and viewing job, traineeship and internship postings;
2)    subscribing to the SGH Career Service newsletter;
3)    modifying own User account.
3.    If the Recipient subscribes to the newsletter, it will be sent to their e-mail address provided by the Administrator.
4.    At any time, the Recipient may withdraw from the newsletter by editing their account settings in the Portal or making a relevant request to the Administrator.

Personal data
§ 6    

1.    The Controller of personal data is the SGH Warsaw School of Economics in Warsaw with its registered office at al. Niepodległości 162, 02-554 Warszawa.
2.    Personal data shall be processed pursuant to the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as “GDPR.”
3.    The SGH Warsaw School of Economics fulfils the obligation of providing Users with information concerning personal data processing rules in line with Article 13 GDPR through a data processing notice on the Portal’s log-in page. The text of the data processing notice constitutes an appendix hereto.

Complaints
§ 7    

1.    If the User finds a failure in the functioning of the Portal or a violation of the Rules and Regulations, they may lodge a complaint by sending a message to the Administrator's e-mail address: serwis.kariera@sgh.waw.pl.
2.    The complaint should at least include:
1)    a User designation;
2)    the subject matter of the complaint.
3.    The complaint will be handled within 14 days from the day the complaint is received from the User, and the decision as to the handling of the complaint will be provided to the e-mail address provided by the User.

Disclaimer
§ 8    

1.    The Administrator is not liable for the content and form of information placed on the Portal by the Users, including job, traineeship and internship postings placed by the Employers, as well as the terms of employment they offer.
2.    The User is solely responsible for their use of content or materials placed on the Portal, particularly of links to webpages not managed by the Administrator.
3.    The above disclaimers do not apply in cases where damage results from the Administrator's wilful misconduct.
4.    The Administrator reserves the right to temporarily suspend the operations of the Portal for maintenance or modification. The Administrator must give the Users prior notice of the down time.
5.    If there is a force majeure event, in particular: war, riots, or large-scale ICT malfunctions which the Administrator could not prevent and which significantly hinder the use of the Portal or make such use impossible, the Portal’s operations will be suspended until the effects of such force majeure events subside.

Final provisions
§ 9    

1.    The Administrator reserves the right to amend the Rules and Regulations for significant reasons, in particular in cases of:
1)    amendments to provisions of applicable law;
2)    the performance of an obligation arising from a final and non-appealable judicial or public administrative decision;
3)    changes due to security reasons;
4)    significant changes in the functioning of the Portal.
2.    Any information concerning amendments to the Rules and Regulations will be provided via the newsletter sent to the User’s e-mail address, or be displayed as a message, with the list of most significant amendments, upon the User’s first log-in after the amendments to the Rules and Regulations are made.
3.    The User has the right not to accept amendments to the Rules and Regulations. If the User rejects the new Rules and Regulations, they may not make further use of the Portal (access to their account will be blocked). Accounts may be removed at the User’s request. 

 

Appendix to the Rules and Regulations for the provision of services in the SGH Career Service

Information on personal data processing
1.    Controller
The Controller of your personal data is the SGH Warsaw School of Economics in Warsaw with its registered office at al. Niepodległości 162, 02-554 Warszawa.
2.    Data Protection Officer
The Controller has designated a Data Protection Officer; you can contact them via e-mail at iod@sgh.waw.pl.
3.    Purpose and legal basis for the processing
The personal data of users of the SGH Career Service are processed in order to make it possible for them to enjoy the services provided by the SGH Career Service. The legal basis for the processing of personal data is Article 6(1)(b) GDPR  (processing is necessary for the performance of a contract you enter into by accepting the Rules and Regulations for the provision of services in the SGH Career Service).
If you choose to subscribe to the SGH Career Service newsletter, the legal basis for the processing is Article 6(1)(a) GDPR, i.e., consent for the processing of personal data.
4.    Voluntary provision of personal data
Provision of your data is voluntary, but necessary to achieve the objectives referred to in Section 3.
5.    Recipients of the data
Where the Controller uses the services of other entities, personal data may be disclosed to them on the basis of contracts entrusting the processing of personal data and those entities will be required to preserve the confidentiality of the data processed.
6.    No automated decisions
No automated decisions within the meaning of Article 22 GDPR will be made on the basis of your personal data.

7.    Processing period
Personal data will be processed for the time you have your account in the SGH Kariera portal. If you subscribe to the SGH Career Service newsletter, the data will be processed until they withdraw their consent.
8.    Rights in relation to processing
You have the right to access the personal data you provided, rectify them, restrict their processing, and erase them where provided for under law. You may withdraw your consent for the processing of personal data at any time without affecting the lawfulness of processing based on consent before its withdrawal.
9.    Right to lodge a complaint
You have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the GDPR.
